Article 1 - Scope

These terms and conditions of sale (the "Terms") apply to any order placed on orbeya.co, published by, and operating under the trade name Virtu'Art (SIRET 843 038 845 00031, 22 avenue de Winchester, 78100 Saint-Germain-en-Laye, France), hereinafter "the Seller". Placing an order implies unconditional acceptance of these Terms.

Article 2 - Products

The site offers for sale the ORBEYA™ product, an LED light-therapy mask with vibration, whose features are described on the product page.

Article 3 - Price

Prices are shown in euros, all taxes included. As the Seller operates under the VAT exemption scheme for small businesses, the mention “VAT not applicable, art. 293 B of the French Tax Code” applies: no VAT is charged. Any shipping fees are shown before the order is confirmed.

Article 4 - Order

The customer confirms their order after reviewing the contents of their cart and completing secure payment via Shopify Payments. An order confirmation is sent by email.

Article 5 - Payment

Payment is due immediately upon ordering. Accepted payment methods are those offered at checkout (credit/debit cards and other methods available via Shopify Payments).

Article 6 - Shipping

Products are shipped from China. Estimated delivery times from order confirmation are as follows:

• France: 3 to 6 days
• Europe (Austria, Belgium, Bulgaria, Croatia, Czechia, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom): 6 to 12 days
• United States: 5 to 8 days
• Canada: 7 to 12 days

These timeframes are estimates and may vary due to customs or logistics factors beyond the Seller's control. In the event of a significant delay, customers are invited to contact the Seller at contact@orbeya.co.

Article 7 - Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without needing to provide a reason or pay a penalty. To exercise this right, the customer must notify their decision through an unambiguous statement (email to contact@orbeya.co). The product must then be returned in its original packaging, unused. Article 8 - Legal Guarantees

All products sold benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), independent of any commercial warranty.

Article 9 - Liability

The Seller cannot be held liable for non-performance of the contract in the event of force majeure, stock shortages at its supplier, or disruption to delivery networks beyond its control.

Article 10 - Governing Law and Disputes

These Terms are governed by French law. In the event of a dispute, the customer may use a consumer mediator free of charge, in accordance with Article L.616-1 of the French Consumer Code.
